Tread carefully if you’re accused of medical negligence

The vast majority of medical professionals got into this industry because they wanted to help their patients. Many of them pride themselves on providing the best care possible. They may feel deeply saddened and upset if they find that a patient has accused them of negligence.

If you’re in this position, you should take a moment to compose yourself before you react. Once someone files a claim against you, everything you do is going to be scrutinized. You may need guidance in navigating such a matter.

Stick to the truth

You’re likely going to be interviewed about the matter. While you might be tempted to tell partial truths to protect yourself, you should tell the actual truth. Of course, you should consult with a professional who can help you ensure that you aren’t incriminating yourself by responding to leading questions during the interviews.

Follow all rules, procedures and protocol

If you’re still allowed to practice after the claim of negligence, you’re going to be under a microscope. Everything you do will be checked and double-checked. Things you did in the past will likely be the subject of an investigation. Be sure that you’re always following established procedures and protocols. The last thing you need is to do something that would validate the claim made against you or subject you to a new one.

Any medical professional who’s facing claims of negligence should ensure they learn their legal rights. This includes their right to defend themselves against any civil claims, as well as actions taken against their medical license. They also need to think about what they’ll do to address any potential criminal charges that they may face.
