OIG Exclusion and Operation Nitengale

I represent 30 nurses facing licensing discipline due to attending one the South Florida fake nursing schools operated by Johanna Napoleon, Gail Russ, and John Pierre.  While I am fighting the disciplinary cases, I am also fighting the OIG exclusions.  A potential Department of Health, OIG exclusion first starts when the client receives a Notice of Intent to exclude 60 days before receiving the Notice of Exclusion.  There is a huge difference between the two letters. CALL ME IMMEDIATELY IF YOU RECEIVED A NOTICE OF INTENT TO EXCLUDE.

Once a nurse or health care provider is excluded, they must file for reinstatement and fight the exclusion.  However, I want my clients to call me and email me any NOTICE OF INTENT to Exclude.  Then we can fight the exclusion with proof of a second license from another jurisdiction.   I have won many of these cases when I can stop the exclusion before it goes into effect.  Once the Exclusion happens, I have to appeal to OIG the exclusion and then also request reinstatement from being placed on the list.

Reinstatement of an excluded individual or entity is not automatic once the specified period of exclusion ends. In order to participate in the Medicare, Medicaid and all Federal health care programs once the term of exclusion ends, the individual or entity must apply for reinstatement and receive written notice from OIG that reinstatement has been granted.

To apply for reinstatement, an excluded individual or entity must send a written request which contains the individual’s or entity’s full name (if excluded under a different name, please also include that name), date of birth for an individual, telephone number, email address and mailing address.
